Meeting was called to order by Mayor Gary Astleford at 5:00 p.m.

Pledge of Allegiance was spoken.

Absent: Tholen

Others Present: Lynnette Swenstad, Ron Kleinschmidt, Dan O’Brien, Kathy Holper, Keven Withers, Charles Miller, Penny Miller

Motion by Emerson, seconded by Anderson, to approve the agenda as presented. All Ayes. Absent: Tholen

Council received the Panning & Zoning minutes from the October 21, 2008 meeting.

The Planning and Zoning approved and recommended to the Council for approval the following:

1. Zoning district changes from C-2 (General Commerce) to C-3 (Highway Commercial) for 308 Nokomis Street West, 310 Nokomis Street West, and 312 Nokomis Street West.
2. Conditional Use Permit – 310 Nokomis Street West – to locate an Automobile Gasoline/Convenience Facility and/or Car Wash on this property.
3. Variance Permit – 310 Nokomis Street West – 20’ variance on the north side and a 10’ variance on the west side for the location of the car wash.

O’Brien is asking the Council for them to approve less pervious surface for the project.

The Council listened to the concerns of the parties involved and after much discussion made the following motions:

Motion by Pederson, seconded by Anderson, to approve that the City grandfather in the existing structure and stay with the 75% impervious surface. Ayes: Anderson, Pederson Apposed: Emerson, Astleford Absent: Tholen

Motion was a tie and the motion failed.

Council had more discussion regarding the issues with the impervious surface. The impervious surface coverage is 75% for C-3 Districts. It was discussed to split the difference of the pervious surface which is 25%. This would change the impervious of 75% to 87.5%.

Motion by Emerson, seconded by Pederson, to approve increasing the impervious surface coverage from 75% to 87.5%. Ayes: Pederson, Emerson, Astleford Apposed: Anderson Absent: Tholen

Motion by Emerson, seconded by Astleford, to approve the Variance Permit of 20’ on the north side and 10’ on the west side for the property at 310 Nokomis Street East. Ayes: Emerson, Pederson, Astleford Apposed: Anderson Absent: Tholen

Motion by Anderson, seconded by Emerson, to approve the Zoning District changes from C-2 Districts to C-3 Districts for the properties at 308 Nokomis Street West, 310 Nokomis Street West, and 312 Nokomis Street West. All Ayes. Absent: Tholen

Motion by Anderson, seconded by Emerson, to approve the Conditional Use Permit based on the recommendations of the Planning & Zoning Commission and with the additional condition that the car wash is shut down at 10:00 p.m. All Ayes. Absent: Tholen
